UPDATE: The regulation and permit would cover state native species only and addresses a current problem. Under current state law in Minnesota, most native herps are classified as “protected wild animals” under CHAPTER 97A. GAME AND FISH of state statute. The bills provide the Minnesota Department of Natural Resources with new authority to permit possession for state native snakes, lizards, and salamanders.

Senate bill 1445 (SF1445) was introduced today (2/25/21). It was referred to the Senate Committee on Environment and Natural Resources Policy and Legacy Finance. The bill author, Senator Ruud, is chair of the Committee. A companion House bill was also introduced as HF1563 and referred to the House Committee on Environment and Natural Resources Finance and Policy. The bill author, Representative Hansen, is Chair of the Committee.

Both bills amend Sec. 27. Minnesota Statutes 2020, section 97A.401, to read:
Subd. 8.
Snakes, lizards, and salamanders.

The commissioner must prescribe conditions and may issue permits to breed, propagate, and sell snakes, lizards, and salamanders. A snake, lizard, or salamander that is obtained from a permitted breeder or that was possessed before August 1, 2021, may be possessed as a pet.
